Noise and Asbestos Surveys

Noise Monitoring

  • Hearing damage caused by exposure to noise at work is permanent and incurable.
  • Research estimates that over 2 million people are exposed to noise levels at work that may be harmful.
  • There are many new cases of people receiving compensation for hearing damage each year, with considerable costs to industry, society and the individuals. Hearing loss is usually gradual due to prolonged exposure to noise.
  • Tearing damage can also be caused immediately by sudden, extremely loud noises.

These conditions are entirely preventable if:

  1. you take action to reduce exposure to noise and provide personal hearing protection and health surveillance to your employees;
  2. manufacturers design tools and machinery to operate more quietly; and
  3. employees make use of the personal hearing protection or other control measures supplied.

Did you know that there are new requirements placed on employers, via the Control of Noise at Work Regulations 2005? You are now legally required to prevent or reduce risks associated with exposure to noise.

We will conduct a workplace survey, which identifies the frequency and intensity of the noise and prepare a report on our findings.

Shell Tankers UK Ltd and Another v Jeromson and Another

The widows of two former employees who died from mesothelioma took this action, as they claimed their deaths were caused by exposure to asbestos during the period of their employment. Shell Tankers was found liable in negligence in both cases but appealed on the grounds that the workers' degree of exposure to asbestos was not such that a reasonable employer should have identified a risk. The Court of Appeal dismissed the appeal, it held that where an employer knew that employees were exposed to asbestos, it should view the risks as those associated with the potential maximum exposure where the extent of a particular employee's actual exposure was unknown. The risks could only be ignored where it was certain that no employees were sufficiently exposed.

If your property is undergoing ANY maintenance, repair or refurbishment it is ESSENTIAL that an Asbestos Survey is completed and an Asbestos Register is referred to before any work is started. If there is not an Asbestos Register already on site or there is any Asbestos present in your property, that has not been reviewed for some time, we can help. We have qualified consultants under BOHS P402 &P405 to conduct full asbestos surveys on your premises, to ensure that none of your employees are exposed.
